What Form BOC-3 Is
Form BOC-3, "Designation of Process Agents," is a filing required by FMCSA under 49 CFR Part 366 for every motor carrier, broker, and freight forwarder operating in interstate commerce. It names a process agent in each state — a representative authorized to accept legal documents (service of process) on the company's behalf if it is sued in that state.
Apex Freight Logistics' BOC-3 was completed and transmitted electronically through an FMCSA-registered BOC-3 filing service, which is the only method FMCSA accepts; paper filings are no longer permitted.
Why It Matters To Carriers & Shippers
A current BOC-3 filing is one of the three requirements — alongside active operating authority and proof of insurance or bond — that FMCSA checks before activating a broker's authority. An active BOC-3 tells carriers and shippers that legal notice can reliably reach Apex in any state where a shipment originates, transits, or is delivered.
